TERMS AND CONDITIONS
M.D.M.X. TERMS & CONDITIONS
The client agrees to pay the total quoted
price. A deposit is required upon booking your requested date as described in your Contract. The remaining balance is due
prior to the stated dates and times in your contract. The client's failure to pay the agreed compensation in full prior
to the date and times of service shall release MDMX from furnishing any services to the client under these terms & conditions.
The deposit is non refundable except as described in paragraph 4 & 6 below. Payments for the deposit, or payments on
account will be accepted in the form of cash, check, money order, and or credit card only. A 5 to 10% gratuity is suggested
(optional) when quality services are provided by MDMX. Final payments will only be accepted in forms of cash or credit card
in the last (7) seven days before services is to be rendered. (Final payments must be in guaranteed funds) These terms and
conditions is contingent upon the receipt of the deposit and contract ( contract must have the clients signature on it) within
(14) fourteen days after the date that the disc jockey signs below. The client agrees to pay a $25.00 service charge for
all returned checks, plus any bank service charges incurred by MDMX. The client agrees to furnish a facility that completely
covers the equipment of MDMX from direct sunlight, and rain. The client further agrees to provide sufficient electrical power
within (50) fifty feet of the location where MDMX equipment will be set up. The clients agrees to provide all tables, skirting
and decorations for the contracted event. The client agrees to provide specific directions to the event location, and access
for MDMX to set-up at least 2 full hours prior to the stated times and date in the contract. The client is fully responsible
for all damages that is caused from their guests during their event. The client is held responsible for all actions
of their guests including other hired staff. (ex. caterers, photographers, and any other personal that may be apart of their
event) No exceptions are made. If damages are caused to any equipment a police report will be filed and financial responsibility
will be expected from the client.
The client may request that MDMX play longer then the time frame listed in contract.
MDMX will provide a longer performance if there are no other obligations and the client agrees to pay the requested overtime
rate. The availability of MDMX to play over cannot be guaranteed.
Every effort will be made to honor the clients
request for a specific disc jockey of MDMX staff (if applicable), however, in the event that the requested Disc-Jockey becomes
unavailable, MDMX reserves the right to send another staff Disc-Jockey. In the event that the client was charged an additional
fee for a specific Disc Jockey, that portion of the fee will be refunded by MDMX.
The disc jockey will make every effort
to play all requests but cannot be held responsible if specific selections are not available. The client agrees that the
quality of the performance by the disc-jockey is not a debatable subject, since this can be very subjective. The client agrees
that the performance of the disc jockey is not to be held against MDMX. All disc jockeys have different personalities and
will provide different levels of experience.
These terms and conditions cannot be terminated by any of the parties
hereto, but is subject proved detention by sickness, accidents, equipment malfunction, or acts of god beyond the control of
the disc jockey. In the unlikely event that MDMX is unable to appear, MDMX will make every effort to find a qualified substitute
replacement. In the unlikely event that a replacement cannot be found, MDMX will make a full refund of any deposit paid by
the client, however, the client agrees that the refund will be the full extent of damages he or she is entitled to and no
further damages may be sought against MDMX. In the unlikely event that the Disc Jockey is delayed and the event does not
start on time, or time is lost during the event due to equipment malfunction, MDMX will refund the portion of fees paid prorated
to the time lost. This is the extent of MDMX's liabilities.
The client agrees not to issue any stop payments or
charge backs on a payment where services have been rendered. MDMX does not permit any chargebacks or stop payments what
so ever. Client agreed to all terms and understands any down payments are for retainers / deposits to hold their date
so know one else can book or have.
The client agrees that these terms and conditions shall be governed
by the laws of the state in which MDMX DISC JOCKEYS reside. In the event of a suit involving or relating to these terms and
conditions, the client agrees that the Venue for the suit will be MARSHALL COUNTY, INDIANA OR LAPORTE COUNTY, INDIANA. In
the event that legal action is taken by MDMX to enforce these terms and conditions, the client agrees to pay reasonable attorney
fees, court costs, and interest to MDMX. In the event that the client takes legal action against MDMX, the client agrees
to pay reasonable attorney's fees incurred by MDMX, unless the client is awarded a judgment against MDMX.
These
terms and conditions are agreed upon by the client and MDMX, and no other agreements, oral or otherwise regarding the subject
matter of this contract or performance for the event stated in your contract. Shall be deemed to exist.
Once
contract is signed these terms and conditions will be a legal binding contract between client and MDMX to said event.
If you are agreeing to these terms online. You will be expected to sign them at the next available meeting we may have.
If no scheduled meetings are done between now and the event date. The contract signer and payee will be expected to
sign the day of event just for legal purposes.
BARS CLUBS & TAVERNS:
ALL ONGOING CONTRACTS AND
REVOLVING ACCOUNTS WILL NEED TO RENDER A 30 DAY NOTICE BEFORE CANCELING A EVENT. HOWEVER, IF YOU ARE ON A CONTRACT ALL
RULES AND GUIDELINES ENCLOSED IN YOUR CONTRACT WILL BE YOUR LEGAL CONTRACT. IF YOUR ESTABLISHMENT DOES NOT TURN IN
ALL THE PROPER PAPERWORK AT THE TIME OF CONTRACTING, THE CONTRACT WILL BE VOID AND SERVICES CAN BE INTERRUPTED UNTIL THE PROPER
PAPERWORK IS FILED. ALL CONTRACTING ADHERES TO THE SAME TERMS AS ABOVE PLUS ALL OTHER TERMS THAT ARE APPLIED TO YOUR
CONTRACT AT THE TIME OF BOOKING AND RESIGNING. ALL PRICING IS LOCKED IN AT THE COST DISCUSSED AND WILL NOT CHANGE, BUT
IS SUBJECT TO CHANGE AT FUTURE CONTRACT RENEWALS. PRICING WILL CHANGE IF SERVICES ARE ADDED OR UPGRADED. NO DOWNGRADES
OR SERVICE DROPS ARE PERMITTED ON A CONTRACT. BY ENTERING YOUR NAME / ESTABLISHMENT / CONTRACTED NIGHT OR NIGHTS / YOU
ARE AGREEING TO ALL THE TERMS AND CONDITIONS ON THIS PAGE.
